Streets and Ways

It was stated in Carmel v. Baillargeon, 21 Mass.App.Ct. 426, 487 N.E.2d 876 (1986), "[w]hen a municipality or other body having authority, by a laying out alters the location of a way, so much of the path of the old road as is not included in the new location is discontinued, without any words of discontinuance." However, for this rule to be applicable, there must be a formal alteration or relocation, which must have been effectuated by the governmental body responsible for the original layout.
