Corporate counsel for MERS is Sharon Horstkamp (email@example.com) and she is very helpful. When we wrote to her to ask how to resolve just a problem like this she responded via email as follows:
If there is either a recorded mortgage granting the mortgage lien to MERS (known as MERS as Original Mortgagee [MOM] Mortgage) or a recorded assignment to MERS, then MERS is the mortgagee. As the mortgagee, the discharge of a mortgage should be executed by MERS and not the Lender.
If you run across situations where the Lender has executed the discharge or an assignment, please bring it to our attention so that it can be correctly resolved. Many times it is simply an oversight that can quickly be fixed.
