Jonathan Buss --- ABC's of Title Insurance
Course Summary: The goal of this course is to explore a wide array of common issues we face when issuing title insurance. Rather than focus on a single issue like tax liens for an hour, we’ll use the alphabet to suggest topics to discuss. While there won’t be time to do a deep dive on any single topic, we will be able to state the issue and either give a concise explanation of it or indicate the red flag it raises under the umbrella of issuing title insurance.

Jonathan Buss --- Power of Attorney and Subordination Agreements
Course Summary: The goal of this course is to uncover the key concepts involving a Power of Attorney including: the importance of reading and understanding a Power of Attorney to its entirety, how a Power of Attorney can be terminated and the underwriting issues related to a POA. This course will also discuss what subordination agreements are, why they arise and requirements for a subordination agreement.

Adam Stricker --- Bankruptcy and Title Insurance
Course Summary: This course will address various bankruptcy considerations as they relate to title insurance and real property transactions. We will first discuss basic bankruptcy background including history and core versus non-core proceedings. We will then proceed to a discussion of the different types of bankruptcy proceedings and the processes and procedures that are unique to each chapter. With a basic background established, we will move on to specific bankruptcy considerations that commonly arise in the real estate and title insurance context including the sale of property out of a bankruptcy estate, the treatment of secured interests and Chapter 13 lien stripping.

John Martin --- Elder Abuse and Title Insurance
Course Summary: The goal of this class is to discuss the relevant warnings signs of elder abuse and instruct in strategies to deal with these very difficult situations. These strategies also involve the customer relations fall out of deciding that a transaction may involve elder abuse. I will address warning signs and the characteristic traits that a typical victim may exhibit. I’ll discuss the legal structure that could cause a loss for a title company and strategies to avoid such loss.

Course Summary: The purpose of this course is to review the various endorsement forms that are available, the circumstances under which it may be appropriate to use endorsements, and the situations in which caution should be exercised when considering if a requested endorsement should be issued.

Sunny Johnson --- Foreclosures: Non-judicial and Deed in Lieu
Course Summary: This webinar will be discussing the 3 main typses of foreclosures we are being requested to insure through. We'll be reviewing the statutes, the time frames and the processes to be sure everything is in order before we insure "post foreclosure".

Glen Roberts --- Homestead and Divorce and Death
Course Summary: This class examines how homestead laws, divorce and community property laws effect title to real property. The class will look at the statutory definitions of homestead and review how homestead rights are created, terminated and encumbered. Additional the class will address how divorces affect joint tenancy and when a divorce decree can be treated as a transfer of title and when the decree cannot be relied on as a transfer of title. The class will analyze several forms of divorce decrees and discuss the issues raised in decree. It will also provide guidance on how to determine if a divorce decree created an equitable lien. The class will be broken down into the following segments. Finally, the class will consider what impact death has on ownership of real property and the methods to transfer title out of the deceased to heirs or third parties.

Adam Stricker --- Identifying and Avoiding Real Estate and Escrow Fraud
Course Summary: This course will give an overview of the most common types of real estate and escrow fraud schemes that are currently affecting the title insurance industry. Topics covered will include fraud involving forged release documents, forged trustee’s deeds, power of attorney issues and situations involving “ghost sellers”. We will also address the increase in escrow fraud including schemes involving counterfeit checks and purported foreign buyers. Finally, the course will cover escrow best practices to defend against fraud as well as common red flags that will help identify and avoid the various fraud schemes discussed.

Bob Cavallaro --- Transfer on Death Deeds - Review and Title Implications
Course Summary: This course will discuss legislation that has authorized the use of Transfer on Death Deeds. Their use is statutorily authorized in 10 of the 12 western states in the western region. We’ll discuss how they fit in with other post mortem transfers of real property and what a valid TODD looks like. Pending the issuance of a bulletin between now and the date of the course, we’ll discuss what needs to be done to create, execute and record a TODD. We’ll discuss what needs to be done by the transferee/grantee of a TODD after the death of the transferor/grantor of the TODD. And finally, we’ll discuss underwriting issues created with TODDs, and solutions and practices to handle those issues.
