This webinar will deal with the various types of entities that are involved with real estate transactions, and the sources within those entities of the authority of individuals to execute documents on behalf of the entities. Among the entities to be considered will be partnerships, limited partnerships, trusts of various types, corporations, non‐profit corporations, limited liability companies and purported entities without adequate documentation. LPOs will also gain an understanding of how to recognize the various entities and what information may be gained about the entities from “outside sources”.

This course will discuss various issues related to easements, including classification of easements, judicial interpretation and recent case law, insuring easements in general, easements as title exceptions and what to look for in an access easement.  We will review and discuss recent title claims involving easement and access rights, including a discussion of the problems pertaining to access rights when no practical route or roadway exists. LPOs should consider the access issues in gathering their information.

This class will focus on scams and fraudulent transactions dealing including warning signs and anonymous real life stories. Discussion will also include identifiable scams to be on the lookout for and how they are affecting the Title Insurance industry.

Bob Wallin --- Bankruptcy

This course will discuss the purposes of bankruptcy statutes and the different procedures followed under Chapter 7, 11 and 13 cases. This course will also discuss the rules for when a bankruptcy court’s approval is required to close the transaction and the effect of a bankruptcy “discharge” upon pre-bankruptcy liens.  Numerous “real-life” examples of escrow transactions that have been impacted by bankruptcy will also be discussed.

Sunny Johnson --- Recording Errors and Issues

The documents we create and insure need to comply with statute (it: essential elements and formalities for a deed); they need to be signed and notarized in accordance with state requirements and they need to be recording in a timely manner.   When they’re not,  claims and even title failure can occur from recording deeds with no legal descriptions; deeds of trust with no legal description that winds up in default and then foreclosure;  incorrect legal descriptions that end up encumbering someone else’s property. There will be a discussion on proper document set up, notarization and recording; examples of errors and the resulting claims.

This presentation will examine commonly seen causes of escrow loss, legal theories and procedures for recovery of escrow loss, and statutes and regulations which may control the recovery effort. We will review the FDCPA and state Consumer Protection Acts, the Bankruptcy Act and the escrow officer’s response to receipt of a notice of a filing, and Small Claims procedures.
