There are many endorsements used in connection with the issuance of title policies. You can see all the endorsements by using the Virtual Underwriter link found under the Agent Support tab, but the most common ones are available here in PDF format for your convenience. You can complete the endorsements online by downloading them to your computer (click "Download") and complete online or save them to complete at a later date. If you need Adobe Reader (a free program) to view the files, click the link below. Note: Adobe Reader does not let you save the changes you make to the endorsements, so make sure you print an extra copy for your records.

Before issuing an endorsement, please check with Stewart to make sure that the particular endorsement you want is applicable and appropriate under the circumstances.

Commercial Environmental Lien Endorsement (pdf) download Document updated:1/23/2004 - Size:9kb The form is used in commercial transactions to provide coverage similar to, but not as expansive as, that provided under the residential environmental lien endorsement. The endorsement insures against loss because environmental liens are of record at the time the policy is issued. As environmental laws do not make provision for permitting commercial mortgages to have priority over environmental liens recorded after date of policy, that coverage (that appears in the residential endorsement) does not appear in this endorsement. Contiguity Endorsement download Document updated:3/23/2004 - Size:113kb Use this endorsement when insuring that parcels are adjacent (contiguous) to each other. The endorsement requires a surveyor's certification. Check with Stewart Title as to whether you can issue this endorsement.

Doing Business Endorsement (pdf) download Document updated:1/23/2004 - Size:10kb This form is revised specifically for Massachusetts, where the failure to register to do business in the state has no adverse impact upon the enforceability of the insured mortgage, although such failure will prohibit the insured lender from using the courts of the state until it has duly registered. The endorsement is generally required from out of state counsel familiar with foreign statutes that do provide for limits on the enforceability of mortgages taken by unregistered corporations. Easement (Access Over) Endorsement (pdf) download Document updated:3/7/2004 - Size:10kb This form is used when the policy insures not only a parcel of land but also an easement that is used to get to the land over from an identified public street. That is, if the public street does not itself provide direct access to the land, but the intervening easement is necessary for such access, use this form to insure the easement. The title to the easement must be fully examined before it can be insured and the endorsement issued. Check with Stewart Title as to whether you can issue this endorsement.

Easement Encroachment Endorsement (pdf) download Document updated:1/23/2004 - Size:11kb This form would be used where there is an easement listed in Schedule B and there is a slight encroachment onto the easement by a structure on the property. In order to issue the endorsement, it must be reasonably established that the easement is not being used at this time and there is no likelihood of use in the future. Fairway Endorsement download Document updated:6/17/2004 - Size:114kb This endorsement provides insurance that certain changes in the composition of a partnership will not result in dissolution of the partnership for purposes of continued coverage under the policy on behalf of the partnership. Check with Stewart Title as to whether you can issue this endorsement.

First Loss Endorsement (pdf) download Document updated:1/23/2004 - Size:9kb This endorsement is usually requested on a Loan Policy if the collateral consists of multiple tracts. It is typically issued in connection with the Tie-In Endorsement. It is designed to provide coverage on a loss (as defined) in excess of a stated percentage of the Loan Policy, even though the lender may have other collateral (ordinarily a loss is not payable under the policy until the lender has realized upon all the collateral.) If the loan is being paid, there is, of course, no loss. Check with Stewart Title as to whether you can issue this endorsement.

Foundation Endorsement 102.4 download Document updated:4/28/2005 - Size:73kb The coverage under this endorsement requires first that (1) a plot plan shows that the foundation is wholly located on the insured property and (2) there are no restrictions, covenants, etc. in Schedule B that prohibit or would be violated by reason of the present location of the foundation. Foundation Endorsement 102.5 download Document updated:4/28/2005 - Size:73kb The coverage under this endorsement requires first that (1) a plot plan shows that the foundation is wholly located on the insured property and (2) there are no restrictions, covenants, etc. in Schedule B that prohibit or would be violated by reason of the present location of the foundation. This endorsement (rather than the 102.4 endorsement) should be used if there are easements recited in Schedule B of the policy. Check with Stewart Title as to whether you can issue this endorsement.

Homeowners Endorsement (pdf) download Document updated:5/18/2005 - Size:77kb This endorsement was developed for use in connection with the issuance of the Homeowner's Policy where the particular agent's software is not yet capable of producing the schedules that are used with that new form of policy. The endorsement will "transform" the older form schedules into those usable with the new policy. Check with Stewart Title as to whether you can issue this endorsement.

Last Dollar Endorsement (pdf) download Document updated:1/23/2004 - Size:9kb The 1992 Loan Policy provides under Section 9(b) of the Conditions and Stipulations that payment in part of the principal of the indebtedness shall reduce the amount of insurance dollar for dollar. This endorsement may be requested where the lien of the insured mortgage secures an amount in excess of the amount of insurance stated in the specific policy. (This might occur where the loan is for the purchase or financing of personal property in addition to the insured real estate. Obviously, insurance for the amount of the loan made upon the personal property would not be purchased, because the loan policy would not cover that collateral.) Check with Stewart Title as to whether you can issue this endorsement.

Location Endorsement (CLTA 116) download Document updated:3/30/2005 - Size:74kb This endorsement is used to indicate that the insured property as described in the policy is shown on the plan attached thereto and to indicate the address of the property and the type of structure erected thereon. Check with Stewart Title as to whether you can issue this endorsement.

Non-Imputation Endorsement (pdf) download Document updated:1/23/2004 - Size:12kb This endorsement is issued in conjunction with either an Owner's Policy or a Loan Policy. It limits Exclusion 3(b) concerning matters "known" by the Insured, not appearing in the public records, not known by the title company and not disclosed to the title company. For example, the endorsement may be requested when a partner is buying the interest of another partner and does not want the exclusion to be applicable as to matters known by the former partner or partners but not known by the new partner. It may also be requested by a new investor as to matters known by the former owner where property is conveyed by the former owner to a new partnership composed of the former owner and a new investor. An explanation of the transaction and the Non-Imputation Indemnity, together with financial disclosures of the parties giving the indemnity, must be first secured. Check with Stewart Title as to whether you can issue this endorsement.

Pending Improvement Endorsement download Document updated:2/19/2005 - Size:83kb This endorsement is used on an owners policy when a substantial (more than 20%) improvement is anticipated, so that the value of the improvements will be included under the coverage of the policy (up to the face amount), if they are erected without knowledge of defects in the title. Check with Stewart Title as to whether you can issue this endorsement.

Physically Open Street (Access) Endorsement (pdf) download Document updated:3/7/2004 - Size:10kb This form is used when the insured property abuts directly upon a street (public or private) that provides a legal right of access to and from the property. Check with Stewart Title as to whether you can issue this endorsement.

Reverse Mortgage Endorsement (pdf) download Document updated:1/23/2004 - Size:10kb This endorsement would be issued when a lender gives a Reverse Mortgage, which is defined under the statute (G.L.c. 167E, §2) as "a mortgage loan in which the proceeds are advanced to the mortgagor in installments, either directly or indirectly, and which together with unpaid interest, if any, is to be repaid at the end of a term not to exceed ten years." As the citizenry gets older and owners remain in their homes longer, this kind of mortgage, and therefore the endorsement, will become more popular. Check with Stewart Title as to whether you can issue this endorsement.

Revolving Credit Endorsement (pdf) download Document updated:2/14/2006 - Size:63kb This form is used to insure the validity of a mortgage that involves revolving credit provisions and the priority of future advances made under such a mortgage.

Secondary Mortgage Market End download Document updated:11/4/2004 - Size:75kb This is Stewart's Secondary Mortgage Market Endorsement that is attached to loan policies insuring 1 to 4 household residential mortgages. (The endorsement is generally incorporated by reference into the policy by way of the use of a check box.)

Subdivision Endorsement (pdf) download Document updated:1/23/2004 - Size:9kb This endorsement insures against loss or damage in the event that the property fails to comply with subdivision laws, and requires an examination of those laws to determine whether the endorsement can be used. Check with Stewart Title as to whether you can issue this endorsement.

Survey (Description Same As) Endorsement (pdf) download Document updated:2/4/2004 - Size:70kb This endorsement insures that the property is the same as shown on a specified survey plan. A certification by a surveyor as to this fact may be required. Check with Stewart Title as to whether you can issue this endorsement.

Tax Deed Endorsement (pdf) download Document updated:1/23/2004 - Size:10kb This endorsement should be distinguished from the "Tax Parcel Endorsement" (which insures that the property is taxed separately from other land). The Tax Deed Endorsement insures that where an easement has been insured in connection with, and as appurtenant to, the primary (dominant) parcel that a tax sale of the (servient) land on which the easement exists will not destroy or adversely affect the easement. This coverage can generally be given because of the provisions of G.L.c. 60, §45. Check with Stewart Title as to whether you can issue this endorsement.

Tax Parcel Endorsement (pdf) download Document updated:1/23/2004 - Size:10kb This endorsement should be distinguished from the Tax Deed Endorsement (that insures the continued existence of an easement regardless of a tax sale on the servient property). The Tax Parcel Endorsement insures that the property is taxed separately from other land, and before the endorsement is issued this needs to be established. The purpose of the endorsement is to avoid the situation where the insured parcel "comes out of" a larger parcel that has been the subject of taxation in the past, and insures under the policy that the insured parcel is now separately taxed and will not be subjected to the tax for the entire larger parcel from which it was separated. Check with Stewart Title as to whether you can issue this endorsement.

Tie In Endorsement (pdf) download Document updated:6/2/2004 - Size:120kb This endorsement is requested on Loan Policies where the lender is making loans secured by mortgages on various tracts covered by more than one Policy and where the mortgages secure one aggregate loan. The lender wishes to aggregate the liability so that loss on each tract will not be limited to the face amount of the Policy on each tract. By issuance of the Tie-In Endorsement, the Company has effectively issued one Policy and pooled liability since there is no apportionment clause under the Loan Policy. The Tie-In Endorsement is sometimes issued along with the First Loss Endorsement. Check with Stewart Title as to whether you can issue this endorsement.

Usury Endorsement (pdf) download Document updated:1/23/2004 - Size:10kb Usury, for all practical purposes, does not apply to loans in Massachusetts. This endorsement can generally be given as a matter of course. (The reference to Chapter 271, Section 49 of the General Laws is to a criminal statute that provides for registering with the Attorney General when a lender intends to make loans at a rate in excess of twenty percent.) Check with Stewart Title as to whether you can issue this endorsement.
