The discussion will deal with the conditions that create foreclosures, the foreclosure process in light of current developments, and the results of foreclosures with emphasis on the role of the title officer and the Limited Practice Officer. We will also consider deeds in lieu of foreclosure and the various structures of deed in lieu transactions and their effect, along with general discussion of insuring third parties after the initial conveyance. LPO consideration will include short sale issues in escrows.

This class will discuss line of credit/equity line deeds of trust from a claims perspective. We will discuss several “real” claims in terms of the root cause; what could have been done to prevent the claim; how the claim was resolved; and, the significance of the claim in dollars.

This discussion will deal with the manner in which surveys, survey maps, and similar information are used in the title insurance process. Indemnity agreements are useful in resolving various insuring issues. This discussion will deal with the when, why and how for these agreements, and how escrow and title considerations fit into the picture. Of particular interest to escrow personnel and LPOs will be the information needed to establish such an agreement, and means of obtaining that information.

We will review the FDCPA and state Consumer Protection Acts, the Bankruptcy Act and the escrow officer’s response to receipt of a notice of a filing, and Small Claims procedures.

We will talk about trust formats, how trusts fit into the work we do, and what and how a trust operates. There will also be discussion about how to obtain the information you need in order to deal with the issues presented when a trust is involved with your title file. Our discusion will also focus on types of powers of attorney, how they are documented, issues of commencement of the powers and termination of the powers, and special problems encountered when we are confronted with proposed reliance upon these delegations of authority.
