These policies provide cover for a range of title defects and problems including:
lack of title due to an exclusion of indemnity in a Land Certificate or following from an ex facie valid a non domino Disposition;
lack of title due to missing links in title such as deeds of assumption, resignation and missing Certificates of Advertising and other documents relevant to a repossession;
lost or missing Affidavits under the Matrimonial Homes (Family Protection) (Scotland) Act 1981 and the Civil Partnership Act 2004; and
adverse mineral reservations resulting in the title being unmarketable; and certain exceptions under Section 12 of the Land Registration (Scotland) Act 1979 including transfers at undervalue and gratuitous alienations.
