In our industry, out of necessity we talk a lot about the underwriting side of construction. However, by comparison we don’t talk nearly as much about the equally important escrow side – particularly as it relates to the owner’s sworn statements, GC statements, lien waivers, change orders, reimbursements, etc. When it comes to commercial construction transactions, there are numerous ways to incorrectly prepare these key documents which require the utmost accuracy in ensuring a smooth and problem-free closing.
